Government Liability

There may be government liability for an unlawful government act, but also for some lawful acts by the government. The government can therefore be held liable for damage resulting from lawful acts as well as unlawful acts. When acting lawfully, for example, the determination of a zoning plan can be correct, but still cause damage to the environment. An example of unlawful action by the government is when an environmental permit is wrongly refused, resulting in major delays in the construction of a project. 

Municipalities, provinces, legal entities under public law can thus be confronted with liability claims if they make an error in the performance of their duties and this error causes damage.
